it's wednesday july 6th, and this is "today in the bay." well, good morning, everyone. i'm scott mcgrew. it's 4:30. let's tart with an east bay foreca, west bay forecast, south bay forecast, all kinds of bay area forecasts with christina. good morning. >> good morning. we're nonexclusionary anymore. good morning to you. although we're concentrating on the east bay this morning, we don't have any problems, really. overall traffic happens to be moving nicely but we've got a lot of construction out there this morning that could slow you down prior to 6:00 a.m. watch out for that northbound 680. you're going to find construction until 6:00 a.m. take you to another spot where the cones might slow you down, live shot of 880, you'll find construction northbound 880 from broad line to avaline.

overall we're seeing a little more volume this morning. looks like more people are headed back to work. stay on top of traffic and weather. weather looking good today, a little monsoonal moisture creeping up, makes for a humid day. your forecast and more trav to come. back to you, scott. >> thanks for pulling double duty. changes coming to the oakland police department, the city's police chief says he's planning to reshuffle the department due to budget cuts. marla tellez joins us from oakland with a preview. good morning, marla. >> reporter: good morning, scott. we all know that change can be good, but in this case it may not be for the oakland police department. the police chief says the department needs to be reshuffled because it currently only has 638 officers. that's almost 200 less than its peak strength of 832 officers back in november of '08. now, a year ago keep in mind budget cuts forced 80 officers to be laid off, now attrition

has his department losing six officers a month at least for the last nine months. he says the major feature of his reorganization plan is to divide the current bureau field operations into two bureaus, each to be led by a deputy police chief. the president of the police union that represents the opd, the plan means less priority will be put on priority crimes such as burglaries and thefts and in many cases wouldn't be investigated at all. chief bass is going to explain all the details about his plan at an 11:00 news conference this morning here at police headquarters in oakland. now, to be clear, scott, chief bass says it is going to be a tough road ahead but he is confident they are going to continue to place a high priority on public safety, of course. >> marla, thank you kindly. today police chiefs and everyone else will meet from all over the bay area to come up with ways to crack down on street gangs, this

after a three-month-old baby was shot to death of the baby isaac garcia was killed when a gunman opened fire on a family car. police say it was a case of mistaken identity. the shooter was trying to avenge his beating at the hands of gang members and thought it was a gang member's car. 17-year-old fabian saragosa is facing charges. a second teen facing weapons charge. looking at a surveillance tape trying to piece together what happened sunday night before a b.a.r.t. officer short and killed a man at a station in san francisco. the video has not been made public yet, but officers say it shows a partial view of what happened. b.a.r.t. police say the man was drunk and holding a knife and threw an open bottle of liquor at the officers right before he was shot. so far they aren't releasing the man's name because they still need to get in touch with his relatives. a south bay man is lucky can

be alive. his neighbor is behind bars because of an argument at a supermarket parking lot. police say the two neighbors nearly crashed into each other while driving at a lucky's parking lot at the corner of blossom hill and snel in san jose. 34-year-old james estrada showed up at the other driver's home and stabbed him several times. that man is expected to survive. estrada will be in court later this week. seven fishermen still missing after the tragic capsizing. photos of the four missing men, some of them from the bay area. the only man confirmed dead is lesliele, retired after years on the chronicle. his daughter said he died pursuing his passion. >> i spoke with him before he boarded the ship in mexico. he was very excited. he was an extreme workaholic,

really dedicated to his family and never put time aside for himself. >> this morning the search continues for bay area men still missing, all missing "today in the bay's" cheryl hurd reports on the band of brothers still holding out hope for their friends. we seem to be having some trouble with that report. the coast guard says it's possible the missing boaters could be found alive simply because of the temperature of the water. it's estimated to be around 85 degrees. this morning fans recovering from injuries after they were hit by a flying bat during the giants game. take a look. the three fans were sitting along the dugout by first base last night when sluggers pablo sandoval, apparently we don't have that tape either, some sort of trouble, bat bounces off the dugout, hits three people, two

men and a wochl the man was hit in the eyebrow, another man in the shin. the woman taken to the hospital in a wheelchair to get checked out of the two men were treated at the stadium. nearly four days and still no sign of professional cyclist who left his bike ride in the east bay and never came back. no one has heard from 29-year-old anthony michael martin since saturday evening. the only trace of him, his cell phone, found on the road. his girlfriend said he had been fasting, hadn't eaten solid food in three days before he disappeared. >> he's of the athlete mentality. he's been able to do these things in the past, go on 150 mile bike rides in one day. >> police say he was riding a fluorescent bike, wearing a blue and white helmet and street clothes when he left for his ride. today state lawmakers would vote on a bill that would let

california crack down on health insurers who charge too much for coverage. the bill would let the state's insurance commissioner or the department of managed health care veto hefty rate hikes. critics say the proposal is too wide reaching and could create a beaurocracy that adds cost but does nothing, they say, to deal with rising medical costs that are driving up insurance rates. an art heist in san francisco, sounds like a hollywood movie. it's the real thing, though. an empty hook marks the spot where a picasso drawing used to hang before noon yesterday at weinstein gallery. police say the man lifted the drawing off the wall and walked out and got away in the cab. that's not the man. that's the drawing of the small pencil drawing is worth more than $100,000. the gallery president said the theft is stunning. >> i feel sorry because it really is truly my goal and always has been my goal to be able to bring exactly what you see in this gallery, original

pretty muggy conditions as we head throughout this afternoon especially in the south bay and in the east bay. you see just to the south of lake tahoe there, we had all that moisture creeping in. yeah, kind of a muggy day. we even have showers and thunderstorms possible in the south bay today. temperatures overall are going to be a little bit cooler. 7 that's it for san mateo, 92 benicia, better than the 100 degree weather we were dealing with in the last couple of days. 92 in concord and san ramon. as we head through the week we lose that monsoonal moisture, so it will start to feel better as we head through friday and saturday. just a couple of muggy days to get through before that. all right. let's get you through some construction and to work on time this morning. we're following traffic for you. no accidents. great news on hump day morning. we do have a few construction zones, though, that could slow you down. they are out there working hard. highway 1 and devil's slide, one-way traffic control until 7:00 a.m. show you how the flow

4:43, a massive dust storm sweeping into phoenix from the desert, 60-mile-an-hour wind driving the wall of dust into the valley. this is just absolutely amazing. dust storms do tend to kick up this time of year. this is one of the largest on record. dust towering over skyscrapers, rolling over entire blocks. it took a few hours for all this to settle down and below away. these clouds usually come and go with monsoon season which last through september in arizona. even lockout will not keep 49ers from trying to tackle tough issues. how the city will pay the $1 million it's going to take to build that new stadium. the 49ers say they sold $138

await key job data later this week. oil prices rose from above the level a few weeks back. you remember this. when the u.s. and other countries announced they would release millions of barrels from emergency reserve. we do get a report on the nation's services sector in a couple hours' time. we'll be watching that to recap yesterday dow slipped 12 points to 12,000569. nasdaq rose nine points to 2825. foreign buyers are helping boost home sales and vacation spots really burned by the housing market crash. the national association of realtors says through march a third of home sales in florida, for instance, were to foreign buyers. that's up 10% from 2007. they are being enticed by low, low prices 30% nationwide since peaking in 2006. lower dollar making their money going farther. miami, fort lauderdale, phoenix, make of the hottest markets now. what is behind door number

two? facebook is making this big old announcement at 10:00 in the morning. speculation is that facebook will either unveil an app for the ipad, photo sharing for iphone or video chat service featured by skype. last week ceo mark zuckerberg told reporters the company will launch something awesome. >> could be all three for all we know. >> i'm voting on skype. we can check back in tomorrow. >> i'm going to head up to facebook after the newscast. so i'll let you know. >> very good. today it is tax cuts versus tax breaks on capitol hill. in just a few hours president obama will meet with democrats and republicans to hammer out a deal on the debt crisis before it is too late. at stake, raising the nation's $14.3 trillion dollar credit limit before time runs out. the country reaches its debt ceiling on august 2nd but the practical deadline actually much closer because it takes time to

analyze and sell any deal. president obama says he's open to compromise but not what he's calling a mini deal. >> i don't think the american people sent us here to avoid tough problems. that's, nfc, what drives them nuts about washington. >> today's meeting includes eight leaders from both chambers of commerce. if lawmakers don't meet this deadline, the treasury department will not be able to pay the federal government's bills. all right. one more time with christina checking weather. good morning. >> good morning to you. we've got some good news coming out of the weather department this morning. if you're looking for cooler weather, we're going to gradually drop off in temperature each and every day through your weekend starting today. we've got warm conditions out there this morning. watch out for high pressure really taking that storm track to the north. as we head throughout the day today, we're going to subtract five to seven degrees from where we ended up yesterday. you can see here monsoonal moisture from the south.

yeah, very unusual to see this monsoonal flow to the north impacting us in the bay area. only happens a few times a year. we've to the this really strong ridge in place situated over the four corners. that's what drives this moisture. it's not counterclockwise low pressure flow, it's wrapping around in a clockwise fashion. here is what we're looking at. if you live in the south you'll notice a difference. a lot muggier, producing showers in lake tahoe this morning. very nush. the biggest difference between yesterday and today will be the drop-off in temperature, 5 in dublin close to 99 yesterday, 79 in richmond, 79 in sant san mateo and 85 today in redwood city. if you're waking up this morning in east bay, temperatures look good, pittsburg 93. a break in places like santa rosa. lake port, 96. ouch. don't get much of a break up

at a live picture of the bay bridge. we'll check in with christina filling in for mike this morning. the history of lesbian, gay, transgender americans could soon become a required part of california's public school curriculum. this bill would require gay history be included in school textbooks. the bill was approved yesterday in sacramento, split nearly among party lines. supporters tell the "san francisco chronicle" the bill would make california the only state to have it in textbooks. opponents say they shouldn't micro manage curriculum. the bill awaiting the governor's signature. she wowed audiences, this morning san francisco remembering the oldest and

continuously performing drag queen. vickie lane died at sf general hospital from an undisclosed illness. she performed in san francisco for more than 50 years at aunt charlie's lounge. in addition to making a name for herself on stage, she was one of the very first people in the nation to undergo gender reassignment surgery. >> she gave a lot to the drag queens here in san francisco. she hired them to perform with her, because they made her look good, okay? >> a memorial will be held at aunt charlie's july 17th. she was 76 years old. nbc bay area teaming up with local food banks and big businesses to help feed the hungry this summer. we worked with subway to raise $30,000 for bay area food banks and station representatives presented that check yesterday. now, the fund-raiser continues between now and july 24th you can drop food off at your local
